How is the security deposit handled?

The deposit equals one month’s rent and follows Maryland Code, Real Property § 8-203. It is refundable, subject to deductions for unpaid rent, damage beyond normal wear and tear and other applicable costs. Interest accrues where required.

The deposit, minus lawful deductions, is returned within 45 days of lease termination. If damages exceed the deposit, it is not returned, but a letter with a detailed itemization is sent within 45 days of lease termination. See security deposit, normal wear and tear and the security deposit guidelines.

How do rent and late fees work?

Rent is due on the 1st of each month. The grace period is 5 calendar days, so payment must be received by the 5th. A late fee of 5% of unpaid rent applies on the 6th day. This follows Maryland Code, Real Property § 8-208(d)(3). See late fee.

How do payment processing fees work?

Residents enrolled in the Resident Benefits Package pay no extra fee for ACH or e-check payments. Residents not enrolled pay AppFolio’s processing fee: 3.49% for credit cards or $2.95 per transaction for ACH or e-check. These are third-party costs and are not refundable.

What does the application fee cover?

The application fee is $70 per adult applying for tenancy. The fee reflects the actual cost of each screening report charged by third-party provider AppFolio, Inc., under Maryland Code, Real Property § 8-213.

Report Cost per applicant
Credit, rental payment history, nationwide eviction and criminal screening $20
Income verification $12
Work Number verification $30
Plaid ID verification $8
Total $70

The fee is non-refundable because it covers actual costs incurred with the vendor.

What if I break my lease early?

Rent stays due until the home is re-rented or the lease term ends, whichever comes first. Tenants pay reasonable re-leasing costs, such as advertising and administrative processing. These costs are not charged if you find an approved replacement tenant before any re-leasing expenses are incurred. They are based on actual incurred costs, as Maryland law requires.

What is the holdover fee?

A holdover applies only if a tenant stays without a signed renewal. The fee is 10% of monthly rent or $150 per month, whichever is greater. If the county caps increases, the maximum county law permits applies. In Prince George’s County that is 6% annually or the Consumer Price Index for All Urban Consumers (CPI-U) plus 3%, whichever is lower.

The tenant gets notice of the holdover amount when the Notice to Vacate is sent, at least 90 days before the end of the tenancy. See holdover tenant.

What other charges can apply?

  • Cleaning and property condition. A general cleaning fee applies if the home is not returned in the same condition, excluding normal wear and tear. Carpets must be professionally cleaned at move-out. A trash removal fee applies if belongings or debris are left. None apply if the home is returned in acceptable condition.
  • Pets. The monthly pet fee is $50 per approved pet. Tenants are also responsible for damage pets cause, assessed at move-out and deducted from the deposit or billed separately.
  • Utilities and maintenance. Tenants pay all utilities unless the lease says otherwise. If utilities are not properly transferred, unpaid amounts are billed.
  • Abandonment and storage. Property left behind is stored for 30 days before disposal under Maryland Code, Real Property § 8-208(f). Tenants owe actual storage fees. No fee is charged if you retrieve your property before disposal costs are incurred.
  • Smoking violation. If smoking occurs in a non-smoking home, the fee covers professional cleaning and deodorizing.
  • Court filing, collections and legal fees. The eviction filing fee is based on actual court costs awarded by the Court. Past-due balances may go to a licensed collection agency or an attorney. Collection fees follow the Fair Debt Collection Practices Act and Maryland Code, Commercial Law § 14-202. Tenants owe reasonable attorney’s fees awarded by the Court if the landlord prevails in an action to enforce the lease. This does not apply to a failure to pay rent case.

Frequently asked questions

What is the late fee for rent?

Rent is due on the 1st and must be received by the 5th. A late fee of 5% of unpaid rent applies on the 6th day. Maryland law caps late fees at 5% of unpaid rent. The late fee is not refundable.

What happens if my payment is returned?

A returned payment fee of $35 applies to each returned check or failed payment. The fee is not refundable. After a returned payment, future rent must be paid with certified funds, a money order or a cashier's check, as the lease addendum states.

Are application fees refundable?

The disclosure says the application fee is non-refundable because it reflects the actual cost of third-party screening reports from AppFolio. Maryland law requires fees over $25 to be returned except amounts actually spent on screening, so the fee is itemized by report.
