Military clause

A military clause is a lease term that lets a service member end the lease early when they receive orders to move or deploy.

A military clause is a lease term that lets a service member end a lease early after qualifying orders. Military OneSource says a lease may include one, that it gives additional protection beyond the law, and that such clauses are common in housing leases near military installations.

The clause sits on top of federal rights. The Servicemembers Civil Relief Act already allows early lease termination after qualifying orders, such as a PCS or a deployment of 90 days or more. Military OneSource notes that a service member who legally waives SCRA rights may not be able to end a lease early without penalty, which is why wording matters.

Owners should have a clear, written clause that states the notice period, what proof is needed and how rent and the deposit are handled at the end. Use the same lease form and clause for every applicant. A clause is a term in the lease, not a tenant preference. See military PCS rental management for owners on orders.
