# Maryland Late Fees and Rent Collection: What Southern Maryland Owners Can Charge and Do

Maryland law bars a lease from setting a late penalty above 5 percent of the unpaid rent for the rental period. Collect in steps: send a written reminder, offer to talk, then give the 10-day notice of intent on form DC-CV-115. Only after that can you file in District Court.

- **5 percent cap.** A Maryland lease may not set a late penalty above 5 percent of the unpaid rent for the rental period. Weekly leases have a separate $3 per week or $12 per month limit.
- **Notice comes first.** Before you file for unpaid rent, you must give the tenant written notice of intent. The tenant has 10 days to pay. The Maryland courts publish the required form, DC-CV-115.
- **Put it in the lease.** A late fee belongs in the written lease. The court looks at the rent due, the due date, and the late fees stated in your complaint.
- **Client late fee terms.** The client's tenant fee disclosure lists a late fee of 5 percent of unpaid rent, charged on the 6th after a 5-day grace period.

## What is the most I can charge for a late fee in Maryland?

The most a Maryland lease can set as a late penalty is 5 percent of the unpaid rent for the rental period. That cap is in Real Property Article 8-208(d)(3). It applies to the lease you write, not only to the fee you charge in a bad month.

The statute does more than cap the number. It lists lease terms a landlord may not use. A clause that breaks the list is unenforceable. If you put a banned clause in a lease or try to enforce one, the tenant may recover actual damages and reasonable attorney’s fees (8-208(g)). Check your lease form against the cap before you sign with a new tenant.

The table shows the 5 percent math for common rents. It is arithmetic on the statute, not a fee schedule.

The last row matters. The cap is 5 percent of the unpaid rent, so a partial payment lowers the top fee. Leases with weekly rent have a different test: no more than $3 per week or $12 per month.

Read our [late fee glossary entry](https://realpmgold.multisites.ai/glossary/late-fee) for the short definition, and see the [Maryland landlord-tenant law hub](https://realpmgold.multisites.ai/landlord-center/maryland-landlord-tenant-law) for the other lease rules in 8-208.

## What late fee terms does the client use?

The client’s tenant fee disclosure lists a late fee of 5 percent of unpaid rent. The same page gives a grace period of 5 calendar days, with payment due by the 5th and the fee applied on the 6th day of the month. The disclosure is dated “as of 2/2/2025” on the client’s site.

That matches the state cap. Your own lease may differ, and your lease controls your own property. If you manage the home yourself, write the due date, the grace period, and the percentage in the lease in plain words. If the lease is silent on the grace period, you invite an argument in court.

The disclosure also lists other tenant charges, including a $35 NSF (returned payment) fee. The 5 percent cap in 8-208 speaks to the late payment penalty. I did not find an official source on other fees, so ask a Maryland attorney before you add charges beyond the late fee. You can read the tenant fee disclosure in full.

## How should I collect past-due rent, step by step?

Start with the lease and a record of what is owed, then move from friendly steps to the legal notice. You can only file in court after the written notice period ends. Here is the order most Maryland owners follow.

1. **Check the lease.** Confirm the due date, the grace period, and the late fee. Confirm the fee is not above 5 percent of the unpaid rent.
2. **Send a written reminder.** Say the amount, the due date, and the late fee. Keep a copy.
3. **Talk to the tenant.** Ask what happened. A payment plan in writing can save you a court case. The Maryland courts also offer mediation before and after a failure to pay rent case is filed.
4. **Prepare the ledger.** The form says the tenant may ask for an itemized accounting of debits and credits (a rental ledger). Have one ready.
5. **Give the 10-day notice.** Use form DC-CV-115. It must list the rent and any late fees claimed, and the date and method of notice.
6. **Wait out the 10 days.** If the tenant pays in full, the matter ends. If not, you may file.
7. **File in District Court.** The next guide covers the filing, the trial, and the warrant. See [the Maryland eviction process](https://realpmgold.multisites.ai/landlord-center/southern-maryland-evictions).

The [notice of intent glossary entry](https://realpmgold.multisites.ai/glossary/notice-of-intent-to-file) explains how the 10 days run. The notice can go by first-class mail with a certificate of mailing, be posted on the door, or go by email, text, or the tenant portal if the tenant chooses electronic notice.

## What must the notice and the court complaint say about late fees?

The notice lists rent and late fees as separate lines and notes that late fees are “due pursuant to the terms of your lease.” The court complaint must then state the rent and any late fees due and unpaid, the rent for each rental period, the day it is due, and any late fees for overdue payments.

This is why a clean lease matters. The judge reads your numbers against the lease. If the late fee in your complaint is higher than the lease allows, or higher than 5 percent, expect the judge to cut it or the tenant to challenge it. Keep payment records, the lease, and the ledger together.

If you win, the court can also enter a money judgment for rent, late fees, and costs when the tenant was personally served. A tenant can stop the eviction in a failure to pay rent case by paying all amounts the court found due, plus court costs, before the eviction is carried out.

## What records should I keep when rent is late?

Keep the signed lease, the Tenants’ Bill of Rights page that came with it, the rent ledger, every reminder, and proof of how and when you gave the 10-day notice. The complaint must state the date you gave the notice, and a tenant may challenge that date. If the court finds sufficient cause, it may dismiss the case.

Proof depends on the method. For mail, keep the certificate of mailing. For a posting on the door, note the date and take a photo. Email, text, and portal notice are allowed only if the tenant elects them, and the law says electronic notice must give you proof of the transmission. A lease may not force a tenant to accept an eviction notice electronically (8-208(d)(9)).

A short written log of calls and texts also helps. It shows the court you tried to resolve the debt before you filed.

## Can I use a lockout or shut off utilities to collect?

No. The way to regain possession in Maryland is the court process, run by a sheriff or constable. Section 8-208(d)(6) bars a lease from letting the landlord take the premises or the tenant’s personal property without formal legal process, except when the lease has ended or the tenant has abandoned the property. The People’s Law Library describes the sheriff’s role on eviction day, and says the sheriff must be present. Do not change locks yourself to make a tenant pay. Ask a Maryland attorney if you are unsure what counts as abandonment.

## What if a county or agency pays part of the rent?

A tenant’s rent may come partly from a rental assistance program. In a failure to pay rent case, an electronic or written check issued by a political subdivision or on behalf of a governmental entity has the same legal effect as the tenant’s own payment (8-401(h)(2)). The People’s Law Library adds that a landlord may not refuse payment from a rental assistance program managed or funded by a county or city.

Maryland also lists source of income as protected in housing. Our [housing voucher guide for Maryland landlords](https://realpmgold.multisites.ai/landlord-center/housing-vouchers-maryland-landlords) explains how voucher rent fits into your lease and your ledger. A voucher is a lawful source of rent, and a late voucher payment is still a late payment to track in the ledger. The glossary has a short entry on a housing choice voucher.

## Does a rental license or lead registration affect collection?

Yes. In a failure to pay rent case, a landlord cannot use the summary ejectment process if a required rental license is missing. The People’s Law Library states: “If a license is required and the property does not have one, the landlord cannot use the summary ejectment procedure.” Check the [Southern Maryland rental license guide](https://realpmgold.multisites.ai/landlord-center/southern-maryland-rental-license) before you file.

For homes built before 1978, the complaint must also state that you registered the property with the Maryland Department of the Environment and renewed it, and give the lead inspection certificate number for the current tenancy. Our [lead paint compliance guide](https://realpmgold.multisites.ai/landlord-center/dme-lead-paint-compliance) shows what to keep on file. Missing paperwork can stop a case that should be simple.

## How does the client help owners collect rent?

The client says it handles rent collection as part of full-service management, and it lists rent collection in its Silver plan and the plans above it. Its owner page lists “Quick payment, days after your tenants pay” and “Online accounting that YOU as an owner can see anytime.” For the term, see the [owner portal glossary entry](https://realpmgold.multisites.ai/glossary/owner-portal).

Tenants pay through an online portal. The client’s tenant fee disclosure lists a 3.49 percent fee for card payments and $2.95 for an ACH or e-check payment, and says the Resident Benefits Package waives the e-check fee. The package is $49 per month for residents who opt in.

For hard cases, the client’s owner page lists eviction services. Its Platinum plan lists rent-paid and eviction filing protections. Real Property Management Gold is not a licensed insurance broker. ## Frequently asked questions

### What is the maximum late fee a landlord can charge in Maryland?

Five percent of the unpaid rent for the rental period. Real Property 8-208(d)(3) bars a lease from setting a larger late penalty. For a $2,000 rent payment, the most a lease can set is $100. A lease with weekly rent has a different limit of $3 per week or $12 per month.

### Is there a grace period for rent in Maryland?

Section 8-208 does not set a grace period. The lease sets it. The client's tenant fee disclosure gives 5 calendar days, with payment due by the 5th and the late fee applied on the 6th. If your lease has a grace period, follow it exactly, because the court reads the lease terms.

### Can I evict a tenant the day after rent is late?

No. Maryland requires written notice of intent to file, and the tenant has 10 days after the notice to pay. You may file in District Court only after that period passes without payment. The notice must use the form the Maryland courts publish, DC-CV-115.

### Can I collect late fees through a failure to pay rent case?

Yes. The complaint states the rent and any late fees due, and the judge decides the amount owed as of the filing date. Late fees must fit the lease and the 5 percent cap. A lease clause above the cap is unenforceable, and the tenant may recover damages.

### How long do I have to sue for unpaid rent in Maryland?

The People's Law Library says a lawsuit for unpaid rent must be filed within three years from the time the rent became due. This is the money claim. A separate court deadline applies to the eviction judgment and warrant. See the evictions guide for those.

### Does the client collect rent for owners?

Yes. The client says it handles rent collection, and rent collection is listed in the Silver plan and the plans above it. Its owner page promises payment days after tenants pay. For the exact steps after a missed payment, contact the office.
